- Neither applicant or spouse has history of unacceptable business activities

- At least 2 out of 4 years residence in sponsoring state/territory as the holder of an Investor (Provisional) visa immediately before the application is made

- Sponsorship by appropriate regional authority required

- Where applicant must be at time of decision
