Spouse 309/100 and 820/801

This involves an overseas person being in a genuine and continuing relationship with an Australian permanent resident or Australian citizen.

If they are not married then the relationship needs to have been for at least 12 months.

In general the department is looking to approve genuine cases and refuse ones that are not genuine or just boyfriend/girlfriend. They will ask for substantial evidence of the relationship including a possible interview. Also you will be asked to complete medicals, x-rays and police clearances.

The applicant is required to complete form 47SP and the sponsor form 40SP. These can be e-mailed on request from Application Forms.
