Permanent Visas

Australia allows people to migrate to Australia or apply for permanent residence (same thing) for a variety of reasons.

Basically each of the main categories are deemed to have a benefit to Australia through either Australia benefitting from the introduction of highly skilled professionals, successful business people, or family reunion.

Skilled Points Test - 136,138, 139

The general processing time is from 5 months (for occupations in demand) to 12 months.





Business Skills visas (including temporary 4 year visas)

This involves a business person applying on the basis of their overseas successful business history. It allows Australia to choose which people will be able to have a good chance of success and be of benefit to the country.

Employer Nominated - 119, 121, 856, 857

This involves an Australian company proving to the Immigration authorities that they have a skilled vacancy that cannot be filled through Australian workers, that they train their existing employees to improve their skills, and that they are financially sound.

The company is required to complete form 785 or 1054. The visa applicant needs to complete form 47ES. These can be e-mailed on request from Application Forms.

The general processing is from 2-4 months.






Spouse 309/100 and 820/801

This involves an overseas person being in a genuine and continuing relationship with an Australian permanent resident or Australain citizen.

If they are not married then the relationship needs to have been for at least 12 months.

In general the department is looking to approve genuine cases and refuse ones that are not genuine or just boyfriend/girlfriend. They will ask for substantial evidence of the relationship including a possible interview. Also you will be asked to complete medicals, x-rays and police clearances.

The applicant is required to complete form 47SP and the sponsor form 40SP. These can be e-mailed on request from Application Forms.
